（2022.03.09）ロシア連邦によるウクライナに対する軍事侵攻に強く抗議し，ウクライナからの即時撤退を求める会長声明 / President‘s Statement to strongly protest against the military invasion of Ukraine by the Russian Federation and call for immediate withdrawal from Ukraine
１，本年２月２４日，ロシア連邦はウクライナに軍事侵攻を開始した。これにより，ウクライナでは子どもたちを含む多くの市民の命が既に失われ，２００万人を超える市民が国外退去を余儀なくされている。今回のロシア連邦による軍事侵攻は，武力行使によるウクライナへの侵略であり，明らかに，国際関係における武力による威嚇又は武力の行使を禁止した国際連合憲章第２条第４項に違反する。
２，さらに本年２月２７日には，ロシア連邦のプーチン大統領は，核兵器による威嚇及び使用の可能性についても言及した。核兵器の使用は破滅的事態を引き起こす行為であり，とりわけ唯一の被爆国である日本として到底容認することはできない。
３，また，日本国憲法前文には「われらは，全世界の国民が，ひとしく恐怖と欠乏から免かれ，平和のうちに生存する権利を有することを確認する」と明記されているところ，ここにいう平和的生存権とは，すべての基本的人権保障の基礎となる人権であり，今日の国際社会において，その国籍を問わず，全世界の人々の平和に生きる権利を実現するための具体的規範とされるべき重要性を有するものである。
しかるに，今回のロシア連邦による軍事侵攻は，ウクライナ市民の平和的生存権の侵害に他ならず，国際社会の一員として，深い憂慮を禁じ得ない。
４，我々弁護士は，基本的人権の擁護と社会正義の実現を使命とする者として，この重大な事態を看過することはできず，当会は，ロシア連邦によるウクライナへの軍事侵攻に強く抗議すると共に，ロシア連邦軍のウクライナからの即時撤退を求める。あわせて，日本政府に対して，この問題の解決に向けた最大限の外交的努力を行うことを求める。

1. On February 24th, 2022, the Russian Federation launched a military invasion against Ukraine. As a result, many civilians, including children, have already been lost their lives in Ukraine and more than 2 million citizens have been forced to leave the country. This military invasion by the Russian Federation is an invasion against Ukraine by the use of force, and clearly violates Article 2, Paragraph 4 of the United Nations Charter, which prohibits the threat or use of force in international relations.
2. Furthermore, on February 27th, 2022, President Putin of the Russian Federation mentioned the threat and possible use of nuclear weapons. The use of nuclear weapons is an act that causes a catastrophic situation and especially Japan, the only country to have suffered atomic bombings, cannot accept it.
3. The Preamble of the Constitution of Japan clearly states that “We recognize that all peoples of the world have the right to live in peace, free from fear and want”. The right to live in peace referred here is the basis of all fundamental human rights. It is important to consider the right as a specific norm in today’s international community to realize the right to live in peace for people all over the world, regardless of their nationality.
However, this military invasion by the Russian Federation violates the right of Ukrainian citizens to live in peace, and we, as a member of the international community, deeply concerned about it.
4. We, as lawyers whose mission is to uphold fundamental human rights and achieve social justice, cannot overlook this grave situation. We strongly protest the Russian Federation’s military invasion against Ukraine and call for the immediate withdrawal of Russian Federation forces from Ukraine. We also urge the Japanese Government to make maximum diplomatic efforts to resolve this issue.
